GOFO Inc., its subsidiaries, and affiliates (collectively “GOFO,” “GOFO EXPRESS,” “We,” “Us,” or “Our”) are aware of how important it is for you to know how we use your personal information and we thank you for trusting that we will do so carefully, sensibly and in strict adherence to the relevant policies and laws. This Privacy Policy describes the way in which we collect and process your personal information through your use of our services, such as delivery services, the website www.gofoexpress.com (the “Website”) including services and features on the Website, the GOFO EXPRESS App (the “Driver App” or the “GOFO App”), as well as other features, technologies, facilities, applications and services provided by us (jointly the “Services” or “GOFO Services”). This Policy applies to all users of GOFO Services within the territories of the United States. By using GOFO Services, you agree to the collection and use of personal information in accordance with this Privacy Policy. Please remember that your use of GOFO Services is also subject to our Terms of Use. This Policy also governs our other collection of personal information in connection with performing our Services. For example, we may collect your contact information if you reach out to us via the Website or the GOFO App (together, the “Websites”) including via any of their email or message functions or features; information of those who manage and use Websites accounts owned by you; or information of those who start but do not complete their applications to be drivers or delivery persons. All those subject to this Policy are referred to as “users” in this Policy.
We collect your personal information that you provide to us:
When you create or update an online account with us;
When you submit any form or application, including but not limited to, application forms relating to any of our GOFO Services or other contractual or employment relationship with us, whether online or offline;
When you use the GOFO Services;
When you directly communicate with us including our customer support, through phone calls (which may be recorded), emails, leave a comment, and other interactive features on the Websites.
We also collect information automatically collected when you visit or use our Websites through the use of cookies, tracking pixels, data analysis tools and any other technologies.
We additionally collect information about you from third parties and other sources, including:

Information provided to us via the Websites including the GOFO App by individuals or entities that are engaged in connection with GOFO’s delivery services (“Delivery Drivers”). The GOFO App is intended to assist in facilitation of the delivery services, by providing Delivery Drivers with information and services related to the delivery services, and by enabling the exchange of information between Delivery Drivers and us or our delivery service providers.
We collect personal information or data that describes, references or relates to an individual or makes that individual identifiable or reasonably identifiable (“personal information” or “personal data”).

You agree not to submit any information to us that is false, inaccurate, or misleading, and you agree to inform us of any inaccuracies or changes in such information. We reserve the right, at our sole discretion, to request further documentation to verify the information provided by you. By requesting GOFO Services, you agree to voluntarily provide the personal information to us for us to provide the requested services.
We take your personal information seriously, and personal information shall only be collected, used, stored or otherwise processed, when necessary, within the framework of responsible, efficient and effective business management of GOFO. GOFO processes personal information based on applicable legal ground. The legal ground is often intrinsically linked to GOFO’s business purpose. This means, for example, that the performance of an agreement can be both a legal ground and a business purpose for GOFO. Therefore, we will first clarify the legal ground on which GOFO processes your personal information and, subsequently, the business purpose that we use your personal information for:

Performing agreements. This includes shipping services, tracking GOFO services, communication with our contractual customer, shipper and other parties regarding services, responding to requests for further information, dispute resolution and preparing agreements (e.g., link the shipment tracking number to your account to enable you to follow your shipment).
Product development, research and improvement of GOFO products and/or services. GOFO processes Personal information as necessary for the development and improvement of GOFO products and/or services, research and development (e.g., analyze information related to the shipment and services to improve our services).
Relationship management and marketing for commercial activities. In general, GOFO processes Personal information as necessary for the development and improvement of GOFO products and/or services, account management, customer services and the performance of targeted marketing activities in order to establish a relationship with a customer and/or maintaining as well as extending a relationship with a customer or business partner and for performing analyses with respect to Personal information for statistical purposes (e.g., send advertising, communications and content more specific to your interests to you).
Business process execution, internal management and management reporting. This includes addressing activities such as managing company assets, conducting internal audits and investigations, finance and accounting, implementing business controls, provision of central processing facilities for efficiency purposes, managing mergers, acquisitions and divestitures and processing Personal information for management reporting and analysis.
Security and Protection. The processing of data for processes such as those related to safety, protecting GOFO and its customers, or business partners, and authenticating the status and access rights (e.g. providing secure services for online and offline transactions) of customers or business partners.
Protecting the vital interests of individuals. This includes processing data when necessary to protect your vital interests or those of other individuals (e.g., for urgent safety reasons).
Compliance with legal obligations. This addresses the processing of Personal information as necessary for compliance with laws and regulations to which GOFO is subject (e.g., checking the names of customers and business partners against blacklists to avoid conflicts of interest, compliance with trade regulations, anti-money laundering and anti-corruption regulations and other policies, procedures and regulations).

Through these cookies and other technologies, we automatically obtain certain personal information as described in this Policy when you visit or use our Websites. We do not share, disclose, or sell your personal information to third parties for money, or share your personal information for cross-context behavioral advertising. We may only share your personal information by disclosing it to a third party for a business purpose essential to the performance of the GOFO Services. We only make these business purpose disclosures under written contracts that describe the purposes, require the recipient to keep the personal information confidential, and prohibit using the disclosed information for any purpose except performing the contract. Additionally, for users who are employed by us, we have shared your personal information relating to your employment to third party vendors for benefits administration purposes.
We have taken adequate safeguards to ensure the confidentiality and security of your personal information. We have implemented appropriate technical, physical and organizational measures to protect personal information against accidental or unlawful destruction or accidental loss, damage, alteration, unauthorized disclosure or access as well as all other forms of unlawful processing (including, but not limited to, unnecessary collection) or further processing, including protecting your personal information against unauthorized access, maintaining the confidentiality, integrity and availability of your Personal information, and training personnel on information security requirements.
However, no security measure can guarantee against compromise. You also have a significant role in protecting your personal information. You should not share your username and password with anyone, and you should not re-use passwords across more than one website. Except as otherwise permitted or required by applicable laws or regulations, we will only retain your personal information for as long as necessary to fulfill the purposes we collected it for, as required to satisfy any legal, accounting, or reporting obligations, or as necessary to resolve disputes. Generally, services relating to the Websites are performed in the U.S. and are intended for U.S. customers and consumers. Your personal information collected by GOFO within the territory of the United States of America will be stored in the territory of the United States of America.
If you are physically located in one of the European Union Countries, please do not submit any personal information to us. If you believe you may have disclosed personal information to us, please contact us immediately and we will remove it. If you are a consumer accessing the Websites from Asia, or any other region with laws or regulations governing personal information collection, use and disclosure that differ from the U.S. laws, your continued use of our Websites or Services, which are governed by the U.S. laws and these terms, indicates your consent to transfer of your information to the U.S.
Based on the law applicable to the use of your personal information, you may have rights that you can exercise in relation to your personal information. Note that in some cases we are not required to completely comply with your request, as such rights may be conditional or because we have to balance your rights against our rights and obligations to process your personal information and to protect the rights and freedoms of others. You are entitled to a copy of the personal information we hold about you and to learn details about how we use it. Your personal information will usually be provided to you digitally. We may require you to prove your identity before providing the requested information.
We take reasonable steps to ensure that the information we hold about you is accurate and complete. However, if you believe this is not the case, you have the right to request that any incomplete or inaccurate personal information that we process about you is corrected or amended.
You have the right to ask us to erase or delete any of your personal information, for example where the personal information we have collected is no longer necessary for the original purpose, where personal information has become obsolete or where you have withdrawn your consent (if we are processing your personal information based on consent). This right can only be exercised when you have provided the personal information to us, and when we are processing that data by automated means on the basis of your consent or in order to fulfil our obligations under a contract with you.
You have the right to object to processing which is based on our legitimate interests. In case of the processing of personal information for marketing purposes, you have the right to object at any time. When you ask us to stop using your personal information for marketing purposes, GOFO will immediately cease to use your personal information. For other purposes based on our legitimate interests, we will no longer process the personal information on that basis when you file an objection based on your grounds relating to your particular situation, unless we have a compelling legitimate ground for the processing. Note, however, that we may not be able to provide certain services or benefits if we are unable to process the necessary personal information for that purpose.
You have the right not to be subjected to automated decision-making, including profiling, which produces legal effect for you or has a similar significant effect. If you believe you have been subject to an automated decision and do not agree with the outcome, you can contact us using the details below and ask us to review the decision.
We may ask for your consent to process your personal information in specific cases. When we do this, you have the right to withdraw your consent at any time. GOFO will stop the further processing as soon as possible after the withdrawal of your consent. However, this does not affect the lawfulness of the processing before consent has been withdrawn.

Delete the personal data

Once we receive a request, we will delete the personal data (to the extent required by law) we hold about you as of the date of your request from our records and direct any service providers to do the same. In some cases, deletion may be accomplished through de-identification of the information. Choosing to delete your personal data may impact your ability to use our Websites and online features, including closure of your online account.
Stop selling the personal data
In the twelve months prior to the effective date of this Statement, we have not sold any personal information of consumers, as those terms are defined under the California Consumer Privacy Act.
No discrimination
We will not discriminate against you for exercising your rights. This generally means we will not deny you using our services, provide a different level or quality of our services. Please know, if you ask us to delete your information, it may impact your experience with us, and you may not be able to participate in certain services which require usage of your personal data to function.
Shine the Light Law
California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. If you are a California resident and would like to make such a request, please submit your request in writing to us using the contact information provided at the top of this Privacy Policy.
CHILDREN’S PRIVACY
Our Service is not meant for, and should not be accessed or used by, anyone under the age of 18. Any personal data submitted pertaining to a child under the age of 18 must be explicitly consented to by that child’s parent or legal guardian. We do not knowingly collect personal data from anyone under the age of 18. If you are a parent or guardian and you are aware that your child has provided us with personal data, please contact us. If we become aware that we have collected personal data from anyone under the age of 18 without verification of parental consent, we take steps to remove that information from our servers.

Our Services may contain links to other websites that are not operated by us. If you click on a third-party link, you will be directed to that third-party’s site. To respond to some rights requests, we may need to verify your request either by asking you to log in and authenticate your account or otherwise verify your identity by providing information about yourself or your account.
